iePolitics: Postmus update

Since I can tell from the blog hits and searches, everyone thinks I have the inside track on what is going with Bill.  Unfortunately, I can’t get Bill to call me.  I’ve tried everything including emailing his sister.  She doesn’t know me.  She asked who I was, and then didn’t respond further.  I don’t blame her under the circumstances.  None of the others have heard from him either.

I received notice from the system that Bill was released late this afternoon.  That should mean they did not find anything in his vehicle.  From what I’ve been told, there is not sufficient justification to search his home, but we also know that Judge Rouse will sign anything.

iePolitics: Happy days are here again!

All of you know I think the world of a couple of my attorneys.  Then there is the attorney from HELL, my worker’s compensation attorney.  Well, several past members of his firm have formed a firm of their own.  I contacted them and they are willing to sub in on my worker’s comp case.

Many of you have asked me for a referral for a worker’s comp attorney.  Ed had given me a link to a good referral service that I hadn’t posted yet.  However, now that Richard Alpers is with a firm, this is who I can recommend to anyone looking for someone who will actually be responsive to you.  Their website can be found at:  www.ranlegal.com.  Richard is in Redondo Beach so he isn’t one of the San Bernardino good ol’ boys who try to screw over county employees like some of the locals do.

iePolitics: Postmus arrested again

Former San Bernardino County Assessor Bill Postmus was arrested in court this morning as he was waiting for his one of his corruption cases to be called.  A sheriff’s deputy escorted Postmus and his attorney to the back of the courtroom and he did not return.  He was transported to West Valley Detention Center on a charge of being under the influence.

iePolitics: Yucca Mesa: Neil it looks like I’m not the only one upset with you

Editor’s Note:  First Neil, they emailed me tonight and asked me to put this on the blog.  I’m not going out and purposely soliciting anti-Derry material.  Second, for all the readers, the information below is in response to the letter sent to Yucca Mesa by Supervisor Derry:  NoXXX On a side note, the last time I received a press release from the Third District I swore the next time I received such a mess I was going to print it out, circle all the errors in red, and send it back to them.  I’m very tempted to do that with this letter.  Do you not have a clue what the proper format for a letter is?

Coalition Response to Neil Derry Letter Denying Yucca Mesa MAC
August 8, 2010

Supervisor Derry has obviously received misinformation about Yucca Mesa’s issues.

The Coalition NEVER said a Municipal Advisory Council would prevent encroachment!  While a Municipal Advisory Council is not full protection from the Town of Yucca Valley to include the Community of Yucca Mesa in their Sphere of Influence with eventual annexation, the Joshua Tree Municipal Advisory Council (MAC) has been in existence for over 15 years and their MAC was  influential in deterring Yucca Valley from attempting to annex them.  It is working for them, why not give it a try in Yucca Mesa?

iePolitics: Blog hits

If we continue at the pace we are at for the next little while, we will exceed 70,000 blogs hits today.  That’s far from a record but it is in the top 10.

When we have days like today I like to look at what people are reading.  The highest ranking article is the Public Defender timeline.  After that two of the Neil Derry pieces and two of the Sheriff’s Department pieces.  Next is the story on environmental wackos.  Rounding out the top ten is the Mitzelfelt piece, the Ruthie piece, and another Derry and SD piece.

iePolitics: So Supervisor Derry, you’re a chicken – I thought you were a Marine!

You chickened out huh?  You know what I mean!  That’s okay.  Public airing of county issues is probably best anyway.

So, you did not provide me with an answer regarding the four bargaining units in SEBA. Of course, we all know the answer already.  And that answer shows my original premise was correct.  The county did in fact tell the unions how the vote would be conducted and what the outcome would be.   This wasn’t simply Bob Blough mouthing off, but an agreement between the county and the unions.

You can’t blame that on the unions.  Greg Devereaux and the Board of Supervisors are clearly at fault here.  You have an obligation when you know that the unions are not conducting elections lawfully to step in.  I’ve told you that; Jim has told you that. But because you liked the outcome and you know a legal election would not have the same outcome, you chose to look the other way.   And that makes you as crooked as the rest.

iePolitics: Ruthie got to be in court this morning

San Bernardino County’s County Counsel and chief legal beagle of many years got to make a court appearance this morning.  Finally.  I’m paraphrasing here a bit, but I believe her involvement this morning was limited to, “Ruth Stringer on behalf of San Bernardino County, your Honor.”  Wow, she should be proud.  She’s moving up to the level of big-time attorneys.  Way to go Ruthie!

iePolitics: Update on the Guasti Command Post Incident

I have now received multiple confirmations that the incident did in fact take place.  I am still trying to verify some of the other participants, but a number of sources have stated that besides for then-Captain Hoops, San Bernardino County Supervisor Paul Biane was also present and among those drinking and having sex with the women.  I am still trying to nail down an exact date so we can do a California Public Records Act request on the call logs, etc.  I am told that Sheriff’s deputies were complaining about the incident but Hoops silenced them.

iePolitics: Am I wrong?

There has been debate recently about exposing cover ups within the Sheriff’s Department of wrongdoing and criminal acts by members of the department.  I would like to address some specific issues and see what all of you have to say about them.

I think the first question would be, Should a law enforcement officer be held to a higher standard than an employee of any other department or business when it comes to committing a crime?  By that I mean for example, if an officer is caught driving drunk, using drugs, or beating a significant other, should he/she be allowed to continue in their position like nothing happened until the matter works it way through the courts, and then only if there is a conviction, does he/she face action on the job?

iePolitics: A brief timeline of the litigation between the county and the SBCPAA

I thought I had sat on this too long, but today’s decision by the San Bernardino County Board of Supervisors to appeal the attorneys fees judgment makes this relevant again.  What you read below is what was sent to me anonymously.  Here it is:

DDA Grover Merritt was elected president of SBCPAA in November 2006.  DA Sharon Caldwell was then the senior labor representative.  (Neither one is a shrinking violet, and Mr. Merritt, as you know, has a special appreciation of the County civil service process.)

iePolitics: Raspberries to Mitzelfelt

This was going to be a much meaner post—I mean comparing anyone to Josie is pretty mean, isn’t it?  But, then I remembered one of Brad’s field representatives, Jessie Flores, did a big favor for me week before last, and I decided I should be a little nicer.  So, here goes the “nice” version of this post.

Brad, what the heck were you thinking?  We expect these kind of stupid decisions out of Josie because she is stupid ,and out of Paul because he is usually drunk, but we expect a tempered, well-reasoned decision out of you.  Today we did not get it.

iePolitics: More Sheriff’s tips

Just when I think it can’t get worse, I get another package, call or email.  I will let you guys tell me what exactly you know about these situations.

First, there is the captain’s son who is thought to have been dishonorably discharged from the military and who could not pass a polygraph as part of the background check but was hired as a deputy sheriff anyway.   Also, there may have been an issue with an explorer scout(s).

iePolitics: The Ristow Lawsuit

I wasn’t going to blog about this because there really is no point right now in arguing the merits of the case.  Anyone who has read this blog for any length of time know where I stand on the issue.  No one is going to believe the outcome I predicted months ago until depositions start being taken and evidence that hasn’t been made available yet becomes public.  Some of you are on Cheryl’s side and some of you are on Mike’s side and I’m not going to change anyone’s opinion.

iePolitics: Environmentalists and the Environment – Part 4

Hinkley's southeast side just down the street from PG&E

In 2003 Los Angeles’ most popular radio talk show hosts, KFI’s John Kobylt and Ken Chiampou, broke wide open a shake-down scheme by the Trevor law firm.  Trevor used a little-known section of California’s Business and Professions Code to file or threaten to file lawsuits against small businesses, especially auto repair shops and restaurants, and then offer to settle if the businesses agreed to pay up.

The “wrongdoing” by these businesses was trivial in nature and often only wrong due to odd or restrictive interpretations of the law.  For example, one suit was threatened because a nail salon used the same bottle of fingernail polish on more than one client.

Businesses found it was less expensive to pay up than to retain legal counsel and fight the lawsuits.   Trevor would have extorted over $20 million from these businesses had Attorney General Bill Lockyear not become involved and shut down Trevor’s scam.

As I have researched the “environmental” movement behind the opposition to the biosolids component of composting and recycling, I have been reminded often of the Trevor scam of a few years ago.  What is good for the environment and taxpayers alike has taken a backseat to the financial gain of so-called “environmental” activists and their greedy lawyers who use loopholes in environmental law and the permitting process to extort large sums of money from California companies even when those companies are creating a green product.

iePolitics: Supervisor Derry and Sheriff Rod Hoops

Supervisor Derry,

The POST issue aside, which we know will never be prosecuted like it should, have you been reading any of our posts regarding the issues with deputies and much higher ups within the San Bernardino County Sheriff’s Department committing crimes?  The story below is a perfect example of why we have such an issue with your response that you support Sheriff Hoops.

You speak of the culture of corruption in San Bernardino County.  I have worked for the county of San Bernardino for 30 years, including a number of years in the upper echelons of county government.  The Board of Supervisors and County Administrative Office I worked for did not come close to being anywhere near as corrupt as the current BOS/CAO and two of those I worked for were charged with federal crimes, with one going to federal prison.  I can only hope that the FBI does as thorough an investigation as it did the last time.  I’ve seen enough to believe our current CAO and at least one board member belongs in federal prison as well.

iePolitics: Cop misdeed of the day – Update

I received an update on one of the more recent San Bernardino County deputy sheriff arrests.  This deputy is a member of the Special Enforcement Division (SED).  Perhaps one of you will clarify for me if all SED deputies are what we commonly know as SWAT team members or are there other functions within that division.

iePolitics reported a few days ago that this deputy was arrested for the second time for driving while intoxicated.  That is not quite accurate.  This is his THIRD incident.  Here is the full story:

iePolitics: Another SBSD coverup?

Editor:  This particular email was sent to all the local papers and the chiefs of staff of all the members of the Board of Supervisors.  Since we have so many San Bernardino County Sheriff’s personnel reading the blog, I know you will vet it for me to determine its accuracy.

According to my sources, a scandal has recently emerged from within the ranks of the Honor Guard and from within the Public Affairs Division itself. The scandal involves the extramarital love affair between a female clerk working in the Public Affairs Division and a male Deputy Sheriff who coordinates the Honor Guard for the Department. He also works within the same office.  That Deputy, a twenty year veteran, has been married to his wife for over 30 years.  The clerk is married to a Sheriff’s Sergeant also on the department. The Deputy and the clerk had a secret affair then left their respective spouses while still married to embark on a relationship and new life together. They initially hid the affair from everyone including their spouses but ironically they ultimately informed their supervisors of it a few months later.

iePolitics: Blogpen

Apparently with the newest version of WordPress I have the ability to change everyone’s status at once, which I guess I did inadvertently a couple of weeks ago when I had to take posting privileges away from one person.  I did not realize it until I had a couple of posts “pending review” from trusted members of the blogpen.  I’m sorry for that.  I have restored your posting privileges to pre-Sam Berdoo days.

Matt Munson: TN Governor Primary Update

Tennessee’s colorful candidate Basil Marceaux unfortunately won 1% of the vote on last Thursday’s Republican Party Primary for Governor. Targetonmyback: POBR Violations – SBSD

I just wanted to get some information to our “Good” law enforcement brothers and sisters in harm’s way. There seems to be a misconception on the administrative aspects regarding sheriff’s personnel. Good or bad cops still have the “Rights” against self incrimination and interview procedures; in any case it is similar to “Miranda Rights” for criminal actions.  Each Law Enforcement officer is covered by POBR. However, the one area of greatest concern is the Violation that some SBSD supervisors are aware of, however they refuse to acknowledge, “3303.” Here is a brief and light history into POBR followed by my recommended reading to all sworn employees of the Sheriff’s Department. There are other sections included but, you should know it, live it, and carry a copy of it.

History:

California was the first state to enact a peace officers bill of rights act: California’s Act is often referred to as “POBR,” “AB301,” “Officers Bill of Rights” and similar names. The Public Safety Officers Procedural Bill of Right Act will be referred to as either “POBR” or “the Act.” It was effective January 1, 1977. The concept originated around 1974 and involved the LAPD Police Protective League and PORAC. The largest supporter of POBR was the ACLU. The bill was signed into law by Governor Jerry Brown.

iePolitics: I would like a straight answer on this one Neil

Did or did not the BOS/CAO give all of SEBA their raises even if they voted to give up their raises.  And please don’t pile on the bullshit about layoffs and units and EMACs and all the rest.  You have a whole lot of people on this blog who have worked for HR and ACR and have been through layoffs a time or two.  We know how it works and what can and can’t be done.  There is NO legitimate excuse for giving raises to those who voted to decline them and not give them to all of us.

iePolitics: Question for SEBA and Attorneys Union members

Bob Blough, general manager of the San Bernardino Public Employees Association, has told his board of directors that although two units of SEBA voted to give up their raises, the county gave raises to all four units represented by SEBA.   Is this true?  How about the attorneys? Did you get your raises or not?

iePolitics: Supervisor Derry: Clarification and more examples

Supervisor Derry, since you have so graciously given up some of your Saturday night and Sunday morning to argue with me on the blog, I am going to give up my morning’s Frontierville play to try to explain to you the points I am trying to make.  As upset as I am about this, you are still iePolitics’ favorite supervisor. :)

As an elected official, elected to any office in California whatsoever, you have an obligation to uphold the Constitution of the State of California and the Constitution of the United States.  Hopefully, we both agree on that.

As an elected official, especially as a member of the governing body of the county of San Bernardino, we the public expect you to initiate an investigation when you have reason to suspect or personally witness unethical or illegal behavior by any person or entity under the purview of your jurisdiction.  That investigation may be as simple as referring the matter to Human Resources or as serious as referring it to the Grand Jury.  No one expects you to call in the Calvary for every act or suspected/alleged of malfeasance, but you are expected to at very least have someone in authority look at the situation to determine if there is any justification for further action.

iePolitics: Well Supervisor Derry, ignoring the elephant in the room makes you as dirty as the rest of them

You know Neil, we try to defend you here at iePolitics most of the time.  But some things are beyond defensible.

For example, your comment that the POST scandal is a personnel matter.  It is NOT a personnel matter.  It is a FELONY matter that involved Sheriff Rod Hoops, former Sheriff Gary Penrod, and at least a couple dozen others ranging from clerical staff to deputy chiefs. It is misconduct of the worst kind by public officials and it is being swept under the rug with the tacit approval of the board of supervisors.

But it’s okay because you all endorse one another for election, donate to one another’s campaigns, and attend one another’s fundraisers.  We wouldn’t want justice to interfere with that, now would we?

iePolitics: So Mikey, here is a real conspiracy and bribery case for you

Mikey, please tell me why you only prosecute some and not others.  You add yet another ridiculous charge to Rex Gutierrez, yet you let the real bad guys go.

We have told you before, and we say it again, you need to go back to law school and study Conspiracy 101 and Bribery 101 again so you can understand the elements of the crime.  Then you need to look at the way in which Scott Ryan got his promotion.

Gary Ovitt was paid off to the tune of $50,000 by SBPEA.  Interview the members of the Board of Directors.  I know some of them will tell you the truth as to how that all went down.

iePolitics: Too bad the FBI won’t make arrests in the Fourth District and beyond

I guess I had what some might call an epiphany this week.  Many of our readers would say it is about time.

You see, for the first time since the corruption scandal started, I genuinely want to see Mark Kirk, Gary Ovitt, Greg Devereaux, and others led away in handcuffs, booked and serve some jail time.  Do I believe it will happen?  No, I don’t.  I still feel the Colonies Settlement is clean.

Everything else in the Fourth District office, however,  is not so clean.  But the problem is that neither Mikey and Moonbeam or the FBI will look at the real dirt.  Mikey and Moonbeam are too busy accepting campaign donations from SEBA and SBPEA.  The FBI isn’t interested in the kind of real corruption that goes on in this county.

In this instance, it is simply not the sort of thing the FBI will get involved with.  I’m not suggesting there will not be arrests made, just not arrests of the county’s most corrupt individuals, except possibly Mikey.

iePolitics: Biosolids

I am in the process of writing the next article in the series entitled “Environmentalists and the Environment” and came across the article below.  I thought it was interesting and it also in a roundabout way underlines the need for facilities other than McCarthy Farms.

Los Angeles Honored for Converting Biosolids Into Green Power

LOS ANGELES, California, April 1, 2009 (ENS) – An demonstration project by the City of Los Angeles that turns biosolids into clean energy has been named as a semi-finalist for the 2009 Award for Innovations in American Government. The award is presented annually by the Ash Institute for Democratic Governance and Innovation at the John F. Kennedy School of Government at Harvard University.

The Terminal Island Renewable Energy, or TIRE, project is the nation’s first aimed at producing green energy from a renewable bio-resource. The resource is biosolids – the organic materials remaining after treatment of domestic sewage at a wastewater treatment facility.

The TIRE project is the nation’s first and only full scale application of deep well injection technology to convert biosolids into green power while simultaneously sequestering greenhouse gases. The Earth’s high temperature biodegrades organic compounds to generate methane gas to produce renewable energy.

iePolitics: Cop misdeed of the day – Part Two

This, of course, is an old one.  It only took six years for there to be “justice.”  Note the quotation marks because “justice” is in the eye of the beholder, or in this case, the receiver.

How many of us could do what Daniel Tidwell did, drag the case on for six years, and then get probation and a fine?  Oops, I forgot.  He is the son of the former Sheriff.  Different strokes for different folks.

Today we are back to drunks instead of tweekers.  This is the second time around for this deputy.

Today’s San Bernardino County Sheriff’s Department employee is a deputy assigned to the Special Enforcement Detail (SED or SWAT).  The deputy may have been involved in an accident while driving drunk, but we cannot confirm that.

This same deputy was involved in a rollover DUI incident about two years ago in the Mentone/Greenspo area.  The California Highway Patrol responded to the crash.  They called the watch commander out of the Yucaipa station, who also responded.

Congressman Joe Baca: Free preventative care provisions will soon go into effect

www.house.gov/baca/

Dear Friend,

I am pleased to share with you new provisions of health care reform that will make preventive care more accessible and affordable. These new regulations, authorized by the Affordable Care Act, require new health plans to cover preventive services at no cost to the patient. Americans currently use preventive services at only half of the recommended rate because of their prohibitive costs.

Comprehensive preventive care can save billions of dollars and thousands of lives. According to statistics from the Department of Health and Human Services (HHS), seven in ten deaths in America result from chronic and often preventable diseases. HHS data also shows that 69 million workers report missed days due to illness each year, which reduces economic output in this country by $260 billion per year. I believe we must do better, and this historic health reform legislation will keep many Americans, especially Inland residents, healthier and save our nation money in the long run.

iePolitics: Attorneys

I have had a number of inquiries lately regarding attorneys.  I’m afraid my Blackberry has been down most of  the time for the past couple of weeks.  I finally had it replaced two days ago, but I had to hand write out all the text messages and I know I am not going to get to them for a while.  So here is the information for my attorney:  www.public-pensions.com However, they are NOT handling my worker’s compensation case.  I will only give the name of that firm out to my worst enemies.

I know my attorney reads the blog every day, so hopefully he will email me a few names of worker’s comp attorneys who are willing to take on cases for San Bernardino County.  If so, I will post those links.  I’m sorry for not getting back to everyone sooner.

Haven’t you had enough yet?  Honestly, why wasn’t County Counsel Ruth Stringer fired today?  She does not work for County Administrative Officer Greg Devereaux.  She works for you.  And she should have been fired TODAY!

I only wish I could share with the readers of iePolitics the details of her latest fiasco—a fiasco that has already been expensive and one that almost cost you, the taxpayers, an additional very large sum of money.

iePolitics: More information on FBI probe

Additional information regarding the Federal Bureau of Investigation’s (FBI) probe into the San Bernardino County corruption scandal has been trickling into iePolitics.  It appears there are two general areas the Bureau is concentrating on: all investigations conducted by District Attorney Mike Ramos’ Public Integrity Unit (PIU) and the Superior Court bench.

Based upon questions being asked by agents, this investigation is wide-ranging.  iePolitics has been told that questions are being asked regarding various real estate deals; destruction of records by former Third District Supervisor Dennis Hansberger; disparity in handling the various FPPC complaints by Ramos against Penrod, Erwin, Biane, Devereaux, and others; the difference in the way in which 1099 charges against Jim Miller and Bea Cortes were handled; the POST scandal; possibly several of the issues at ARMC (regarding Supervisors Biane and Gonzales); and much more.

CRP: Democrats begin jockeying for 2014 Democratic gubernatorial nomination

Rep. Loretta Sanchez forms 2014 Gubernatorial Committee

With growing doubts surrounding Jerry Brown’s highly competitive race for Governor, Congresswomen Loretta Sanchez announced yesterday she’s forming a Committee to raise money for a gubernatorial run in 2014.

With Jerry Brown running an uninspired campaign for Governor, jockeying for the 2014 nomination for Governor has already begun,” said Crystal Feldman, press secretary for the California Republican Party. “Nervous Democrats, uneasy over Brown’s likelihood of capturing the Governor’s office and extending his decades-long tenure on the California state payroll, are starting to hedge their bets. Even Brown’s supporters are showing uneasiness that he has no plan to create jobs, lacks any proven ability to manage budgets and protect taxpayers, and has no clear path to restore California’s economy. After 40 years in politics controlling Sacramento’s back rooms, it looks like Democrats are poised to issue Jerry his gold watch and move toward the next chapter.

Maxine Waters, despite recently touting their closeness.  The House Ethics Committee today announced that, having been under investigation since 2009, Waters is headed to a public trial on charges of ethics violations.

The two collegues appeared together a mere two weeks ago at an event in Inglewood, CA where Boxer detailed their close friendship: “When she came to the House, I went over to the Senate and we became buddies, partners. We call each other when there are tough issues. We help each other out.”

Case in point:  A few weeks ago there was an article about a new group formed called the Inland Empire Destination Council.  This council’s purpose is to promote San Bernardino County for something besides corruption.  They started their own website and blog, which I find very humorous because iePolitics and InlandPolitics will always receive more hits and have a higher SEO ranking than anything positive the county puts out.  But I digress.

iePolitics: A new radio show on the horizon

Nevada Development Department may fund it so it really won’t be pleasing to California politicians.  My host does not hold back and I will be helping him learn the lay of the land and who all the players are.  He is going to say “daring to say all the things you can’t if you live in Ramos country” and other snap.
