iePolitics: More on Judge Lemkau and Baby Wyatt

Someone has stirred the pot today besides for Paul Schrader.  It has forced me to stop long enough to post a little more information on this subject.

First of all, here is the press release from the San Bernardino County Sheriff’s Department: Baby Wyatt.   As you can see, there is no mention whatsoever of a police pursuit. Here are a few additional details I have been made aware of.

First, Judge Lemkau was not the first judge to deny Katie Tagle’s request for a restraining order, but at least the third.  There is actually some startling evidence (in all three judges’ favor) that I’m trying to verify and get copies of to post. Continue reading

iePolitics: Can justice be found in San Bernardino County? – Part 3

So far in this series we have discussed the District Attorney’s office and the Conflict Panel.  There are three other components to justice, or the lack thereof, in San Bernardino County:  the Public Defender, the Sheriff’s Department, and the Superior Court bench.  Today, we will discuss the office of the Public Defender.

The Mission Statement on the wall of the Public Defender reads:

The Public Defender protects the constitutional rights of indigent defendants by providing skilled legal counsel and passionate advocacy at all critical phases of state level criminal and civil commitment litigation.

It is hard to believe that Public Defender Doreen Boxer would have the audacity to post such a blatant lie once one knows what really goes on at the Public Defender’s office.  iePolitics has been contacted by numerous Public Defender employees with stories of retaliation for helping clients and tales of conspiracy with the district attorney’s office to the detriment of justice.   And both actions seem to be allowed and rewarded.

But is it really that bad?  I mean, crooks going to jail, and deservedly so, is a good thing, right?.  The Sixth Amendment to the Constitution of the United States reads:

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

So, yes.  It really is that bad.  Anything that violates the Constitutional rights of any citizen of the United States is bad, very bad.  Perhaps today it is a serial murderer but tomorrow it could just as easily be you or I.  Once we lose our freedoms granted to us by the Constitution of the United States, America no longer exists.  And that why what is happening in San Bernardino County’s justice system is so troubling.  Literally, we are watching those who have committed no crime be prosecuted with malice.  And those who are trying to defend any who have been charged, punished for doing their jobs. iePolitics: Ramos Under Investigation By The FPPC – Again

San Bernardino County District Attorney Mike Ramos is once again under investigation by the Fair Political Practices Commission (FPPC)  See letter:

This is the second letter received from the FPPC on this matter. The first letter acknowledged receipt of the complaint and advised they would determine if there was enough evidence to investigate. The 460 speaks for itself so it would have been hard to say there is no evidence.

Basically, the complaint alleges that Ramos used his campaign account as a slush fund—something he is accusing everyone else of doing. And it appears that he used his campaign account so that his county credit card would not be scrutinized. Continue reading

Candidate for Sheriff Paul Schrader discusses concerns from San Bernardino County Sheriff’s Staff.

SHERIFF PAUL SCHRADER 2ND AMENDMENT SHERIFF

During the past three months I have had discussions  of importance with some San Bernardino County professional staff,  deputies, detectives, sergeants,  lieutenants and 1 captain.

One area of concern is the Mini 14 rifle.  Most sworn staff do not like the Mini 14′s.  I prefer the AR 15 over the Mini 14.

The following evaluation is based on law enforcement evaluations in the USA. The Ruger’s Mini-14 is not as reliable or accurate as AR-15 rifles, which was discovered in an  impartial evaluation of the two rifles in a head-to-head comparison. I think we need to give the deputies the opportunity to purchase and carry AR 15′s on patrol.  I will also authorize them to take them home for protection.

I will implement the AR 15 program after I am elected sheriff.

Another area of concern is the Hoops’ good ol boy establishment in the Department. I will immediately begin to work on transparency within the ranks of our Department to break down the good ol boy system. This will help regain trust with the executives and staff in the Department. The promotion system and discipline system will be improved to help remove the good ol boy system. It will also be fair and transparent.

The last area of concern I will address at this time is professional staff.  I will ensure the professional staff receive the training and respect they deserve as members of our Department.

Appointed Sheriff Rod Hoops Supports Supervisor Paul Biane in this election. Do we need a fresh start?

This is why we need a fresh start in the San Bernardino County Sheriff’s Department.  I have been at meetings where Rod Hoops has said there are big problems on the 5th floor with the Board of Supervisors and he will not go there without a witness with him.  Then he supports one of the problems. I also received the flier with Hoops and Ramos together.  The voters get it.

Why do we need a fresh start? When you have a cloud of corruption over all county government and the board appoints the Sheriff, it is time to vote out all the incumbants.

What do I want to bring into the Department?

Transparency

As part of my fresh start approach to the San Bernardino Sheriff’s Department, it will be my duty to see that the Department is above reproach in order to restore and retain the respect and trust of the public. My first objective is to make all areas of the Department transparent, especially the jails. There will be an open dialogue maintained with the community and community activists who have questions regarding the Department, including the jails.

In order to bring justice to those wronged and closure to those who have done right, I will have all internal investigations expedited. The community will know the truth, and Deputies will be treated fairly and in accordance with “The Peace Officer’s Bill of Rights”.

Judicial candidate Ed Montgomery and candidate for sheriff Paul Schrader host a public information session on Thursday, May 20th in Rancho Cucamonga about GPS with victim notification. The candidates encourage all interested members of the public to attend because this information will save lives.

Victim notification GPS allows a potential victim of violence to be instantly notified when a person they have a restraining order against enters within the forbidden perimeter established by that order. When a potential threat enters the area a victim can use that warning to take evasive action and protect themselves. This technology prevents any chance meetings in public places in addition to locations outlined in a court order. iePolitics: Question for Court Employees/Law Offices

My attorney’s office filed a peremptory writ of mandate on my behalf almost a month ago (actually, as of today at least 20 days) at the San Bernardino Courthouse.  The clerk’s office says they are “too busy” to actually file it, conform a copy, and enter it into the computer.  Last week they said they might get to it this week and this week they say they might get to it next week.   They did say they will backdate it to the actual day it was brought into the courthouse.  Meanwhile, it can’t be served and time will not start running until it is served. Voters hoping for a San Bernardino County Sheriff’s candidate debates before deciding who to support in next month’s election are out of luck so far. Candidate Paul Schrader Sheriff/Coroner had worked with local radio talk show host Barb Stanton to schedule a forum in May at Victor Valley College with candidates Rod Hoops and Mark Averback. All three candidates had agreed back in April to appear in this forum. Barb Stanton was informed on Tuesday, May 4, 2010, by David Ellis, Hoops’ campaign manager, that Hoops would not participate in the forum. Ms. Stanton asked why and Mr. Ellis said neither of the other candidates have enough money for us to be concerned with it.

I believe the voters need the opportunity to see the differences in the candidates. I believe in voter choice and I think the statement regarding who has enough money, shows a disconnect by the current administration with the voters in the county.

iePolitics: Can justice be found in San Bernardino County? – Part 1

Justice is defined as “the upholding of what is just, especially fair treatment and due reward in accordance with honor, standards or law.”   In other words, in a county run by scoundrels, justice is hard to find.

In part one of this series we are going to examine the San Bernardino County District Attorney’s Office, District Attorney Michael Ramos, and the relationships the office and its elected leader enjoys with the county’s criminal justice system.

Let’s start by defining the role of a district attorney in California.  California Government Code section 26500 states:

The district attorney is the public prosecutor, except as otherwise provided by law.

The public prosecutor shall attend the courts, and within his or her discretion shall initiate and conduct on behalf of the people all prosecutions for public offenses.

As you can see, the definition is simple, yet broad.  The ability to “initiate and conduct on behalf of the people all prosecutions for public offenses” makes a county’s district attorney one of the most powerful positions at the local level.  And when that ability is mixed with politics, it becomes one of the most dangerous. It seems we are really making a headway in this election.  A few of my signs have been missing in action in some areas. I have had a couple pulled up 10 feet from two other candidate’s signs, one is an appointed candidate.

I have a picture of my sign attached, if you see someone walking around with one of my signs, they are either a supporter or a thief.  I think someone believes that’s the way to kill a grass roots candidate.

iePolitics: Can justice be found in San Bernardino County? – Introduction

Justice in San Bernardino County has become as elusive as a Sasquatch or the Lockness Monster.  Perhaps not as evident to the public but obvious to many of those close to the system who witness the backroom deals, the personal relationships between oppositing parties, and the actions taken for political gain.  Only in San Bernardino County do we have the Public Defender sleeping with the District Attorney literally; the Conflict Panel, which is supposed to represent indigent defendants, donating heavily to the District Attorney and Sheriff; and judges with financial arrangements connected to officers of the court.

“Innocent until proven guilty” is simply a slogan of a bygone era that has given way to a system of justice mired in politics and apathy.  The Constitution of the United States be damned if it doesn’t fit the political plans of a chosen few who are not afraid to use the power granted to them by that same constitution to  use the justice system for political and financial gain. Tuesday morning the San Bernardino County Board of Supervisors will considering waiving its attorney-client privilege protecting communications related to the litigation and 2006 settlement of the lawsuit between the County Flood Control District and Colonies Partners, LP.

The $102 million settlement was to compensate for damages created by flood control actions resulting from the construction of the 210 freeway in Upland.

Our county’s resident lying snitch is at it again.  Yes that’s right.  Pinocchio aka Confidential Informant No. 1 aka the yellow singing Canary, aka Adam Aleman is bragging once again about the testimony he gave to the San Bernardino County Grand Jury this past Monday and Tuesday.  Now, he has already pissed the Grand Jury off once by altering evidence  he sent to them.  That brought about just a few felonies.  Now, he seems to have forgotten he is not supposed to be telling us all what was said during the hearing.  But, this is the brash young Mr. Aleman and he can’t help himself. iePolitics: More About Judge Robert Lemkau

Judge Robert Lemkau is a Superior Court judge in San Bernardino County, assigned to the Victorville, California courthouse.  He recently made nationwide news for denying a restraining order that resulted in the death of 9-month-old Wyatt Garcia after suggesting that Wyatt’s mother was lying to the court.  This is not the first controversy for Judge Lemkau in his brief career.

Robert Lemkau was admitted to the California State Bar in 1972 and started his career as a deputy district attorney with the San Bernardino County District Attorney’s Office in November 1972 after a brief stint with the Legal Aid Foundation of Los Angeles.  He spent 13 of those years prosecuting crimes against children. InlandPolitics: Letter to Jeff Burum

I meant to post this earlier today, but ran out of computer time.  This reminds me of one of the very first conversations Mark Kirk and I had in 2008.  I chastised him for accepting contributions from Colonies.  He told me that Jeff does more for other people in a week than most do in a year.  He said that Jeff is very charitable.  I know he helped me when I needed it most. I’m glad to see his peers are supporting him.

We write this letter to ask you to cease your passive stance towards District Attorney Michael Ramos.

News of the unwarranted attack on your reputation and credibility, and that of your friends and supporters has reached many of us in the last forty-eight hours.

You have been a respected member of your community for years. You have been unselfish in helping your community and neighbors. You built your business from nothing and have come so far to have it all destroyed by this man.

We commend your passion in devoting countless hours of your life to assist those less fortunate in life by contributing back to not just your community, but areas throughout the United States.

You have so many friends and supporters from around the country who stand ready to help you address what has been forced upon you.

It is the understanding of many of us that District Attorney Ramos actually looked you in the eye and assured you that no evidence of any wrongdoing had ever been found against you. It is also our understanding that a Mr. David Ellis, a representative for the District Attorney informed you that a clearance letter directed at you was forthcoming.

iePolitics: S.B. County: Time to Consolidate the Public Defender and the District Attorney

In iePolitics’ always-continuing quest to assist San Bernardino County administrators in balancing their budget, we have happened upon an obvious cost-cutting measure.  We know that District Attorney Mike Ramos and Public Defender Doreen Boxer have already joined . . . um . . . forces, in a Biblical sense of course, so the next step only makes sense.  It’s time to consolidate the two departments and allow District Attorney Ramos to have the final decision over all criminal proceedings in San Bernardino County.

“We can’t do that,” you say.  Why not?  Conflicts of interest do not seem to be of concern to anyone.  Take for example, one of the most recent campaign contributions to Ramos of $10,000.  That contribution brings the total to $83000 that the law affiliation of conflict panel attorneys James Spring and Earl Carter have given to Ramos since 2004 to support his re-election.  This equates to 15 to 20 percent of all campaign contributions received in that same period.  The conflict panel attorneys are Ramos’ single largest contributor. iePolitics: The Colonies Settlement Agreement, Part I

Yesterday’s new conference with San Bernardino County District Attorney Michael “sexual predator” Ramos and California Attorney General Jerry “Moonbeam” Brown seemed to include a lot of  hyperbole and leave out a few facts.  In one of the latter political whore’s best effort at grandstanding, Brown stated,

What is significant here is the most appalling corruption case in decades, certainly in the history of San Bernardino County and maybe California itself.  Individuals corrupted public office and were able to grab more than $100 million of the taxpayers’ money through this scheme.

There is one very big problem with this statement.  The county had lost twice in court already.  It was strongly suggested to the county by the trial court judge that it attempt to reach a settlement.  The Colonies asked for $300 million and the county settled for $102 million.  That settlement was negotiated with the help of a mediator who just happened to be a retired California Supreme Court Justice.

iePolitics: Will copulating with the District Attorney prevent criminal prosecution?

Twelve citizens of the city of Grand Terrace have a filed a request with District Attorney Mike Ramos to investigate one of his many mistresses for Government Code section 1090 violations.  Which mistress you may ask.  Yes, I realize it is difficult to keep them all straight.  This time around it is Bertha Bea Cortes, a councilwoman for Grand Terrace.

Cortes has bragged to community members about her relationship with Ramos and her use of that relationship to effect a prosecution of fellow councilman Jim Miller for, you guess it, Government Code section 1090 violations.  What’s that old adage about “living in glass houses”?

Unlike Miller, Cortes’ violations appear deliberate.  Additionally, Cortes, who sources indicate to iePolitics has children living in the home, reports no income whatsoever despite an active real estate license, and advertising by herself and her broker on her behalf.  It is unclear how she paid to keep her license active or for the advertising, or for that matter how she feeds and clothes her children with no income.  There are no $11,000 payments on Ramos’ 460 to Cortes, so her source of support remains a mystery.

iePolitics: Thank You

Just wanted to say “thank you” to everyone who said a prayer for me today.  It was a very trying day but also a victorious day.   Prayers were answered.   Now, please continue to keep me in your prayers because the perpetrator in this situation could not be angrier and I have found him to be a very vengeful person who has no regard for the law.

Special thanks to the two friends who accompanied me to court this morning.  I was a very stressed out person and they kept me sane.  Also, the court staff and Judge Steve Malone could not have been more professional.  And the Sheriff’s deputy who came out to keep the peace was also very cool.  However, the Sheriff’s deputy who took a side without hearing both sides is not so cool.  Again, not everyone who says they will get a court order is bluffing.

iePolitics: Breaking News

iePolitics has learned that as a part of the ongoing corruption investigation additional, previously-unreported search warrants were issued at the homes of high-ranking county officials including that of at least one current chief of staff.  When serving the search warrants, District Attorney investigators photographed the interior of the homes and those photos are now available to defendants as part of the discovery process.

As new information is obtained, it will be reported here.

iePolitics: It has nothing to do with the sex, stupid!

Reading the various comments on the Mike Ramos Sexual Harassment investigation stories is enough to make my brain hurt.  It seems few understand the underlying issue.   A possible lawsuit has little to do with consensual versus forced sex.  It has nothing to do with the level of attractiveness of either party.  It does have to do with abuse ofpower lies, coverup, and more lies.
