iePolitics: SEBA Attorney William Hadden

The information in this commentary is for the benefit of those presently employed members of the San Bernardino County Sheriff’s Department.  READ carefully and THINK!!

I hope not only the general members of SEBA read this and take heed, but the station representatives who are concerned with William Abernathie and Michael Eagleson not being forthright in the fiduciary duties towards  SEBA members.

Members need to know that these same issues are going on with current members and their cases as we speak. If these issues are not brought forth, members will continue to suffer for the benefit of a few. Just like we are seeing every where else.

On February 5, 2010 I filed a 14 page complaint against SEBA attorney William J.Hadden of Silver,Hadden & Silver.

The complaint was filed with Peace Officers Research Association of California/Legal Defense Fund. The complaint was addressed to the Board of Trustees.

The Board of Trustees heard the case in San Diego, Ca on April 24, 2010. On May 18,2010 I received a letter from Edward Fishman the Legal Administrator for LDF.  I was informed by Mr.Fishman, that the Board has taken the appropriate administrative action against Mr. Hadden as a result of my complaint. Judicial candidate Ed Montgomery and candidate for sheriff Paul Schrader host a public information session on Thursday, May 20th in Rancho Cucamonga about GPS with victim notification. The candidates encourage all interested members of the public to attend because this information will save lives.

Victim notification GPS allows a potential victim of violence to be instantly notified when a person they have a restraining order against enters within the forbidden perimeter established by that order. When a potential threat enters the area a victim can use that warning to take evasive action and protect themselves. This technology prevents any chance meetings in public places in addition to locations outlined in a court order. Judges and law enforcement have the ability to independently verify the compliance to the restraining orders established in their court.

Ed states “This technology can and will save lives, and I want to do everything I can to bring it to the family court system in San Bernardino County”  He adds that “I look forward to using another tool on the bench to protect the children of our community.”

Paul Schrader in addition to saving lives focuses on how as sheriff this system can greatly reduce the public costs associated with needless murder and reduce calls for service related to officers having to come out to enforce protective orders. “When a potential violator knows they will get caught, many of them stay home and find something else to do.”  Paul speaks from his experience as a homicide detective that “Sadly I have personally worked on too many murder cases where the victim would still be alive if they had victim notification GPS.” Continue reading

Seriously, now you guys (and gals) know what it is like to have an ineffectual union in bed with management.  About time you share our pain!

I’m hearing a lot of muffled voices suggesting it is time you look for a new president.  Well, duh!  I wasn’t going to throw this out there until after the June 8 primary, but one name has popped up a time or two and that is Mark Averbeck.  He certainly has shown he is not afraid of Sheriff’s brass.  I seriously doubt you would ever find him with a brown nose.  Think about it!

Appointed Sheriff Rod Hoops Supports Supervisor Paul Biane in this election. Do we need a fresh start?

This is why we need a fresh start in the San Bernardino County Sheriff’s Department.  I have been at meetings where Rod Hoops has said there are big problems on the 5th floor with the Board of Supervisors and he will not go there without a witness with him.  Then he supports one of the problems. I also received the flier with Hoops and Ramos together.  The voters get it.

Why do we need a fresh start? When you have a cloud of corruption over all county government and the board appoints the Sheriff, it is time to vote out all the incumbants.

What do I want to bring into the Department?

Transparency

As part of my fresh start approach to the San Bernardino Sheriff’s Department, it will be my duty to see that the Department is above reproach in order to restore and retain the respect and trust of the public. My first objective is to make all areas of the Department transparent, especially the jails. There will be an open dialogue maintained with the community and community activists who have questions regarding the Department, including the jails.

In order to bring justice to those wronged and closure to those who have done right, I will have all internal investigations expedited. The community will know the truth, and Deputies will be treated fairly and in accordance with “The Peace Officer’s Bill of Rights”.

iePolitics: Are Abernathie and Eagleson Lying?

I have received a couple phone calls in the last couple days, asking several questions about SEBA station representatives and specifically William Abernathie and Mike Eagleson.

The first issue was a question about how one goes about recalling a station representative. I am told by a person in the know, you seek out those at your station who are not happy with what your station representative is doing. If you have a majority, put it on paper, approach SEBA and the Executive Board and present your case. I think you will need the names of those who wish their station rep to be replaced. Basically you need a vote of no confidence at the station level.

Since I am hearing more than a few complaining about transperancy, those who wish to recall their station reps might wish to approach ALL the reps at a monthly SEBA meeting. I think that might be the better approach at this time. LET everyone know what is happening versus just a couple. Continue reading

SECOND AMENDMENT CANDIDATE for SHERIFF PAUL SCHRADER/SAN BERNARDINO COUNTY AT THE GUN SHOW!!!

Sheriff Paul met with over 200o people at the gun show, at the Sheriff Paul Schrader booth.  I spoke to the members at the West End Gun Club a few months ago and I am pictured with a few guys from the club at their booth. This was a success for our campaign and we had a great time. I will knock the walls down to CCW’s in San Bernardino County.  I also want people to enjoy open carry and regain their second amendment rights!!!!

I met with the NRA and they already knew that Sheriff Paul was the only real second and tenth amendment sheriff’s candidate in San Bernardino County.

ACU: SEBA a “Non-Adversarial Approach”

In the last couple years I have heard many terms used by SEBA’s staff and their attorneys.

Terms like, “I have to work with these people everyday”.  “Don’t care the Deputies lied”. “What do you care it’s not your money”.  “Not a good idea to upset Judges”. “Not a good idea to sue cops”. “Not a good idea to put management on the witness stand”. “We enjoy a good working relationship with management”. “No we can’t do that to another SEBA member because we will have to represent them later”. “It’s their department they can do whatever they want”.

And now someone says, we take a “non-adversarial approach” in dealing with the County. Continue reading

iePolitics has received information that Safety Employees Benefit Association (SEBA) president William “Beef” Abernathie has negotiated a deal with the county behind the backs of SEBA members to cut the pay raise to 6 percent and postpone it for two additional years.  We are awaiting clarification and will post it as soon as it is received.

iePolitics has received a few tips regarding the case of Deputy Richard Heverly.  He is the deputy who while off-duty pulled a gun on a tow truck driver in Riverside County.  A Riverside County jury recently deadlocked and the judge declared a mistrial last month on whether Heverly was guilty of assault with a semiautomatic firearm, assault by a public officer, making criminal threats and false imprisonment. Voters hoping for a San Bernardino County Sheriff’s candidate debates before deciding who to support in next month’s election are out of luck so far. Candidate Paul Schrader Sheriff/Coroner had worked with local radio talk show host Barb Stanton to schedule a forum in May at Victor Valley College with candidates Rod Hoops and Mark Averback. All three candidates had agreed back in April to appear in this forum. Barb Stanton was informed on Tuesday, May 4, 2010, by David Ellis, Hoops’ campaign manager, that Hoops would not participate in the forum. Ms. Stanton asked why and Mr. Ellis said neither of the other candidates have enough money for us to be concerned with it.

I believe the voters need the opportunity to see the differences in the candidates. I believe in voter choice and I think the statement regarding who has enough money, shows a disconnect by the current administration with the voters in the county.

Paul Schrader: Candidate Paul Schrader’s signage must be collector’s items

It seems we are really making a headway in this election.  A few of my signs have been missing in action in some areas. I have had a couple pulled up 10 feet from two other candidate’s signs, one is an appointed candidate.

I have a picture of my sign attached, if you see someone walking around with one of my signs, they are either a supporter or a thief.  I think someone believes that’s the way to kill a grass roots candidate.

Many might be wondering why they should vote for Paul Schrader.  Well lets look at some of what I believe to be common sense issues. NO masters degree needed.

This is nothing personal against Mark Averbeck. I admire his fortitude and no-nonsense approach to the Captain Gray scandal in the last week.  Some think that Averbeck’s approach is nothing more than political grandstanding.  Maybe.   Or maybe Mark is just tired of what he has seen in his career. I had the opportunity to spend some time yesterday discussing the current San Bernardino County’s budget situation and was able to obtain some feedback on the thinking behind what is happening, and to further explain my point that not reducing the county workforce now, will cause greater pain later.

Let’s face it. Signs of the current economic downturn were visible as early as 2006. I brought up the potential collapse in real estate prices and the effect on the county while working at the Assessor’s office then. I was laughed at by many at the government center.

InlandPolitics Commentary: Public employee unions should consider layoffs

The “800-pound budget gorilla” is in the room for both Riverside and San Bernardino Counties, which is putting their respective employee unions in a critical dilemma.

Push wage and benefit concessions on their members or trigger layoffs. Layoffs cause reductions in union member rolls thus affecting revenue that supports operations.

In mild economic downturns, wage deferrals or not filling vacant positions can be a viable band-aid to get through the problem.

Not this time.

The current collapse in property and sales tax revenue in both counties is devastating, and will continue for some time. San Bernardino County, which has not been as aggressive as Riverside County in reducing its property tax rolls, took a 6% hit last year and is likely to take another hit of at least 9% this year. That’s 15% over two years. Continue reading

At some point before you are released from your interview with IA, you will be ordered not to discuss the investigation with anyone but your lawyer, SEBA representative or your Commander. LOL!!! don’t say anything to your Commander he or she is not going to be your pal in all this.

The Department like any other Law Enforcement agency has a responsibility to the public to investigate mis-conduct and be free from interference from you or anyone else in order to complete that investigation.

It is my position that once that investigation is complete, and you have been given notice of the proposed discipline by the department, their investigation is DONE.  What seems to happen depending on the nature of the charges and who you are, IA will again admonish you to remain silent. It has come down from a couple sources that Sheriff’s Management has let it be known, that Sheriff’s personnel arrested for DUI would be on their own. What exactly does this mean?

If the Sheriff’s Department never covered these incidents up in the first place, there would have been no need to make such a statement to the Station Commanders.

Is Sheriff’s management now indicating in their own way alcohol abuse might be a problem within the Department as Sheriff Lee Baca did with his department a few months ago? Paul Schrader: Paul Schrader candidate for Sheriff of San Bernardino County backs three pro-gun bills.

We need to see change regarding the gun laws in California.  Call your lawmakers and tell them you want the law changed.

On Tuesday, April 6, the Assembly Public Safety Committee will consider three pro-gun bills.

Assembly Bill 2053, sponsored by Assemblymember Jeff Miller (R-71), would clarify the current statutes for law enforcement to issue a concealed firearms license.  Under AB2053, the “good cause” stipulation would apply to self-defense, defending the life of another, or preventing crime in which a human life is threatened. You might have heard the term, “obey now grieve later”.  This is managements and SEBA’s way of telling you obey all orders, then complain later about a potential problem with the order.

Just one REAL big problem with all that.  Who do you grieve too?  The one you are going to grieve to is the one who is generally creating the problem. For those of you who are impressed with those in public office or elsewhere who have all these degrees hanging from their walls, and we must include their many years of experience that they often tell us about, think about this.

What University did they attend and what was their grade average for the almighty “common sense”, they are suppose to have learned about?  Ah I forgot for a moment that is something that cannot be taught. Seems you either have it or you don’t.

Scary thought when District Attorney’s, Law Enforcement personnel, and Judges simply have no common sense it already adds to problems with politicians who generally have none what so ever. Some exceptions, but few.

Sheriff’s Internal Affairs Part 2

 

In part 2 we will discuss personnel files and issues related to that subject.  Remember what I said, “THINK” about these issues.

This is from the Goverment Code that pertains to the “Peace Officer’s Bill of Rights”. Pretty simple language actually, and the code must be interpreted by the Courts for it’s “plain language meaning”, and “legislative intent”.

I hope to add a little insight on what goes on behind the scenes in the Sheriff’s Department Internal Affairs Division, both for our civilian readers and those un-informed employees, and sorry to say some misinformed ones also.  For those employees who have not been there, I hope you never do, but if that time comes, READ this and think.

I should state that everything in this article is my personal opinion based on past experience in dealing with IA investigators, SEBA reps, lawyers and many hours reading case law as it pertains to these issues, and of course speaking with many employees regarding their adventures with those in IA. As many of us have read over the years the words used by public officials, “I can’t comment on that, it’s a personnel issue”, or “confidential employee matter”.

This law as we know it, is becoming one of the most abused in the public sector.  Our public officials are claiming these laws apply in internal matters, and as we are starting to see, being used to cover up corruption.

I would also like to add, when I discuss the issue of investigations by deputies regarding a CCW,  I will use civilian investigators to save money. I think sending a patrol deputy out in uniform to do a background check is expensive and bad management of resources.  Sending contract or civilian investigators out is cost effective.

Paul Schrader: Fiscal Conservative-San Bernardino County Sheriff’s Department

I would like to bring a Fresh Start to the San Bernardino County Sheriff’s Department financing and budgeting reviews. I will appoint a volunteer committee to review the audit and devise solutions to maximize the use of funds currently being spent in the Sheriff’s Department, especially to make available the maximum amount of technology and resources to the Deputies working in the field and in the jails.

I will be exploring the possibility of using resources such video cameras in high-crime areas, electronic monitoring systems, shot spotters, and an automatic license plate recognition system to identify stolen vehicles. The feasibility of adding K-9′s and volunteers into the ranks will also be explored.

Paul Schrader: K-9 UNITS- San Bernardino County Sheriff’s Department

When I am elected, I will bring back the K-9 units (dog units) to San Bernardino County Sheriff’s patrol.

The deputies in the field tell me, they are mad at the command staff.  They have lost faith in them.  When I talk to deputies in patrol they tell me, “we need our K-9 units back” and they get mad when they talk about it. They feel that their safety is compromised when approaching a building or car with armed suspects and unable to use a K-9 unit. They are able to ask other agencies for K-9 help from time to time.  This is unacceptable.

Paul Schrader: Transparency- San Bernardino County Sheriff’s Department

Transparency

The questions asked at most of my events and from people all over the county is, what are they hiding, and why is the sheriff and his command staff not open and available to the public.

As part of my fresh start approach to the San Bernardino Sheriff’s Department, it will be my duty to see that the Department is above reproach in order to restore and retain the respect and trust of the public. My first objective is to make all areas of the Department transparent, especially the jails. There will be an open dialogue maintained with the community and community activists who have questions regarding the Department, including the jails.

In order to bring justice to those wronged and closure to those who have done right, I will have all internal investigations expedited. The community will know the truth, and Deputies will be treated fairly and in accordance with “The Peace Officer’s Bill of Rights”.

Paul Schrader: Community Responsibility- San Bernardino County Sheriff’s Department

My name is Paul Schrader, and I am running for the position of Sheriff-Coroner of San Bernardino County. My campaign is based on what we call the Fresh Start Initiative. My goal is to bring a Fresh Start to San Bernardino County that the citizens can be proud of, participate in, and see concrete, forward-looking solutions to the problems we face.

Community Responsibility- A Sheriff’s Department that accepts its responsibility to the community, and works with the community to improve
conditions for all.

The other day I was in Chino Hills. I was talking with a guy by the name of John. He said he would like to see the Department executives reaching out to the community, finding out what needs and concerns they have.  He said when he has tried to reach anyone of any rank, he is directed to a patrol deputy.  He is frustrated.

While in Victor Valley I talked to Helen. She had a few of her friends with her. She said she wanted a group to help bring the Department and community together. She said the Department said she could volunteer. She tried to call the Sheriff’s Office and was redirected to a patrol deputy. She does not want to be a volunteer, she would love to be part of a community group that could partner with the Department. She is frustrated.

I hear this throughout the county. Deputies are being utilized to answer questions that should go through Department executives. Our deputies are trying to provide law enforcement services and need tools to do the job even better.

I will have community groups in every area of the county. We will meet and work together, ensuring they are getting service needed in their area. I will be available to citizens. This is being done in Departments all over the State.

San Bernardino County announced last Friday that it was delaying a planned budget workshop for another month.

For a county that has been asleep at the switch in closing an estimated budget shortfall of $90 million-plus in its upcoming fiscal year is anyone surprised?

Neighboring Riverside, Orange, Los Angeles, and San Diego Counties have at least been continually taking budget reduction steps in an effort to keep their respective situations manageable. Continue reading
