SBGrapevine: Assemblyman Curt Hagman: Freshman Success

Assemblyman Curt Hagman is expected to easily win election to his second term on November 2.  After all, he enjoys a safe Republican seat.  But that doesn’t mean he took it easy in his first two years as an assemblyman representing the 60th Assembly district.  Rather he is known as a hard worker, but more importantly, as a solid Republican and a consensus builder who can communicate with Republicans and Democrats alike.

Hagman was rewarded for his communication skills early on in his career when he became the Minority Floor Leader.  His leadership capabilities became evident the last day of the regular session where he was able to prevent 35 controversial or frivolous bills from being voted on through his management on the floor by using the rules of the Assembly in the voting process.

ACT: The anatomy of a public-private buddy system

According to Redlands City Attorney Dan McHugh, Debbie Scott-Leistra, Human Resources Director, had personally introduced private attorney Steven Filarsky to the Redlands City Council in early 2008, to provide legal services in labor negotiations and grievance matters.  As with many of labor attorney Filarsky’s previous work experiences, Ms. Scott-Leistra  “cut her teeth” while serving in Ontario City where she worked in the Personnel Department, as a manager, with private attorney Filarsky made available to advise and assist her on an “as-needed” basis.  On one occasion, Ms. Scott-Leistra physically accosted an employee in City Hall over a written request for approval of outside employment, which was then “covered-up” by the administrative powers that be with the full cooperation of private labor attorney Filarsky.  Being accustomed to this type of work arrangement and environment involving political favoritism and retaliation, such as with the Scott-Leistra/ Filarsky public-private business relationship in Ontario City; one should not be surprised that the Ontario Police Department would refuse to even write-up a police report concerning Ms. Scott-Leistra’s activities, supposedly receiving concurrence from the County District Attorney’s office that no crime had been committed in the incident.

Sometimes you put walls up not to keep people out, but to see who cares enough to break them down.

I came across the above quote on a friend’s Facebook page a few moments ago.  If ever there is a sentence that sums up the relationship aspect of depression, that is it.  I know I’ve destroyed more relationships than I can count for that exact reason.

You know the other person isn’t going to live up to expectations; you know you’re the one that is going to be hurt; you know you’re setting yourself up for failure; and you can’t stop yourself.  Head and shoulders above everything else that is depression, this is the most frustrating aspect.  And I think it is the part that most leads to suicide.

Over the previous two weeks, The Alpenhorn News has reported in detail on Neil Derry’s questionable choices related to some individuals selected to fill key positions on his staff. The series began with an exclusive report on the criminal ebackground history of his Administrative Analyst Wanda Nowicki. Next, the paper examined the polarizing and controversial history of his ex Chief of Staff, Jim Erwin, that culminated with his 2009 arrest at Derry’s office on felony charges related to the $102 million Colonies Scandal.

Sam Berdoo: Jason Desjardins and the Court of Public Opinion, Part I

Despite what to me defies common sense, and despite Jason’s own statements on the public record, he can not legally be prosecuted for any violation of the law that he may have committed in regards to the alleged theft of his illegally transported firearm.  Supposedly, that has a lot to do with “habeas corpus” and no proof that the gun existed. You will have to figure that out for yourself.   Let’s be correct, but not for Jason’s own behavior and his public proclamations, Desjardins would not be in this extremely embarrassing situation.

We need to ask ourselves, “In a time of rampant corruption in San Bernardino County, do we really need to have this kind of person in elected office”.  Elected Officials are subject to a higher standard of scrutiny than the general public. Like most politicians today, Jason is all for transparency, except when it pertains to him.  An Elected Official has a duty, responsibility, and an obligation to adequately explain and answer questions related to  the circumstances surrounding his personal conduct when such subjects are brought into the Court of Public Opinion.  The public has a right to know about the conduct, both  past and present, of their elected representatives.

Sam Berdoo: Councilman Jason Desjardins: Alleged Thief Back In Court

According to court records, accused political sign thief, Jason Desjardins is to appear in Superior Court this morning in Department S9, at 8:30 am. This matter had been continued over from May 2010 at Desjardins’ request in order to conduct discovery and interviews. I recall Jason and his Brother were caught red-handed, in broad day light, in front of cameras and witnesses, stealing Mayor Morris’ and Dennis Baxter’s political signs. It looks like Jason could be in trial by the end of August.

Well, Isn’t it interesting how Jason is always involved in these murky situations and always seems to squeeze by. I can assure you that had you or I admitted to illegally caring a firearm, we would have been cited and sanctioned. Ramos has already been accused of special treatment for his good friend, Bertha Cortes. This is another case of selective prosecution, in this case, not to prosecute.

There are two issues with what this informant claims.

First is the issue of being a county employee with a criminal record.  I have seen the county try to fire employees for less than drunk driving.  I have also seen them hire convicted felons.  In one case the employee went to state prison not once, but twice, on felony drug charges and was hired back both times while on parole.  So if you are a favorite, it doesn’t matter what you do.  And if you are not, you better not get a jaywalking ticket.

Whited: San Bernardino County will never shed its tarnished image

Action speaks louder than words. San Bernardino County Supervisors claim they want to clean our tarnished image and they prove it by tarnishing it up some more. They never miss an opportunity to take the low road.

Observers say this group of five is the most ineffectual and dysfunctional Board in memory. They have been paralyzed for two solid years as the district attorney conducts an investigation into their crimes. Not one can claim innocence and prove it by acting with intestinal fortitude. Each is like whipped puppy hoping for reprieve.

The post below is so long, I thought I would respond separately.  The biggest thing for me in this issue is that the HelpHinkley people try to make it sound as though Nursery Products is dumping raw sewage in the middle of their school yard.  Nothing could be further from the truth.

First, technically, the town of Hinkley doesn’t even exist.  It is an area outside of Barstow, near Lenwood.  There are no “Welcome to Hinkley” signs on any of its borders nor is there a traditional government-supplied sign indicating population,  elevation and boundaries.  So where Hinkley begins and ends is subject to interpretation.

As I read various blog comments and accounts of Rancho Cucamonga City Councilman and former San Bernardino County Assessor employee Rex Gutierrez’ corruption trial and non-verdict, I realize the magnitude of what happened Wednesday is lost on most.  Let me explain.

The District Attorney pulled out all stops to keep this case from going to trial any sooner than necessary due to his re-election campaign and fear certain information might come out during the trial.   Gutierrez refused to waive time further.  The District Attorney used every procedural delay available and the trial did not commence until the last possible moment.  The District Attorney was hoping a smoking gun would materialize but it never did.  The District Attorney’s hand was forced. InlandPolitics.com is still piecing together information still being received related to the contract vote by the San Bernardino Public Employees Association (SBPEA).

It’s seems to be boiling down to the money. The unions money!

The potential long-term loss to SBPEA of at least ten percent of it’s county employee membership would cost the union about a quarter million dollars in dues revenue annually.

iePolitics: It’s a Conspiracy!

I’m feeling very pissy right at this moment because I got kicked out of the courtroom.  I was told I’m on the witness list.  How  the heck can I be on the witness list?  I have not been subpoenaed nor have I been interviewed by EITHER side.   So when were they planning to interview or subpoena me?  After the “not guilty” verdict is read so I can say, “I told you so.”

Aluminum foil aside, I know they have no intention of calling me as a witness.  They never have.  They just want me out of the courtroom so when little Adam and little Andrew testify.

Readers on the San Bernardino Sun blogs are speculating that today’s search warrants involve Jeff Burum and Colonies Partners.  That is not the case.  The subject of the search warrants appears to be Upland Mayor John “JP” Pomierski.  The search warrants were served on City Hall and his home.  They were also served on two additional locations but those locations do not involve Burum or Colonies Partners.

I appreciate the many efforts of the event organizers who have made it possible for grassroots candidates like me to present our campaigns in public forums. I thank the many community organizers who come to these events and then tell their friends and neighbors.
 
My campaign has been truly a family affair from my patient wife, to my son out there handling signs, and my daughter who as campaign manager put in more hours than the rest of us. I thank my staff and my friends who every step of the way went out there with their families talking to voters. I never could have done it without you.
 
Thank you to my fellow candidate Paul Schrader for all of the hard work with my campaign. It was a great experience to work on bringing Victim Notification GPS into our community with you and get to know your wonderful family.

Vic Stull is on the Run

Vic Stull can’t run from the voters forever…….

This election year I have been out in the community earning your vote. My friends, family, and I are out at events talking to voters and answering the tough questions voters have about our court system.

My opponent on the other hand is sitting at home expecting your vote to come in without working for it.That is when he is not at the country club with other members of the San Bernardino political establishment who expect voters to just keep the status quo.

I have participated in no fewer than 4 public forums that I verified Mr. Stull was also invited to participate. I welcome the opportunity for voters to contrast our skills and most importantly our temperaments when it comes to this position. Mr. Stull has stayed home.

The last ten years I have volunteered my time on the bench as a substitute judge on the family court bench. Mr. Stull has had this very same opportunity, but did not feel that he owed it to our community to take on this training and develop a record of conduct on the bench among his colleagues before running in this election.

Yesterday Mr. Stull made what I believe to be his one public appearance in this campaign since I declared my candidacy. He spoke at the Redlands Country club. I exhausted every effort to work with the meeting organizers directly. Despite my request to be a part of this forum and have equal time to present why I am the better candidate for judge, I have been shut out. Clearly my speech would have been more dynamic compared to Vic’s presentation. This is why he made sure I was not there.

Ask who does Mr. Stull think he needs to be protected from? Is it the voters?

This election year we even have a candidate for judge in another race facing protesters when he goes out in public, but even judge Lemkau is making more of an effort to meet with voters than Mr. Stull.

Does Mr. Stull need to be protected from another distinguished member of the legal community? A man who has to hide from his opponent in the campaign clearly shows a lack of ability to manage conflicts. Judges who can’t manage conflicts, can’t manage a courtroom, and can’t face the contentious nature of litigants in the court.

I can assure Mr. Stull that I am many times more professional, courteous, and restrained than the many self represented litigants that come before the San Bernardino courts who are frustrated, yet deserve the opportunity to have a fair hearing.

Our courts see people on the worst days of their lives, and deserve compassion. The courthouse is not a country club and our community is ill served by jurists who believe it should be a place where the priviledged hold all the power and the common man has no rights.

Our courts serve all walks of life. I am proud to have worked my way up from a modest upbringing to where I am today always understanding that the dignity of an individual before me is not measured by their bank account or the clothes on their back.

Voters ask yourself: where is Vic Stull?

Don’t vote for a man who thinks the only worthy voters are the country club voters. Our courts have too many judges who sit in judgment of our community, without ever participating in it.

Remember to use your head and vote for Ed.

Rules That Govern Medical Services

The rules that govern the delivery of medical services are multifaceted. It is not just one agency or level of government who oversees its delivery. Each discipline has its licensing or certification board that dictates how that profession may practice. Each setting (hospital, nursing home, clinic, etc.) has guidelines that allow it to operate and be licensed. Then there are rules that dictate how private insurance pays for services. Rules on how care of private-paying patients can function. Government funded care such as Medicare and Medicaid also have their rules on how they should be billed and what acceptable services can be billed. In addition, there are often both state and federal rules within the same area that must be adhered to. Each of these may have different expectations. When this is true the “Most Restrictive” rule must be followed.

To their detriment, most health care professionals have expertise in one or two of these areas. They often unwittingly violate regulations they don’t know but are responsible to follow. The violations here are not whether a physician can give away free care or whether services can be undocumented by a physician. The physician scope of practice rules are only one component of compliance in a hospital setting. The fact that services are delivered in a hospital setting means that the hospital is responsible for the services delivered and that the rules and laws that govern it must be followed.
Potential non-compliance may exist in two areas:
1. State and federal licensing laws, and
2. State and federal reimbursement guidelines

Title XXII is the group of state laws that dictate licensure of health facilities. Services delivered in a health facility must be documented. It is not an option whether or not to document care or not. It is a requirement. Federal licensing laws also require that all care delivered must be documented. Late entry of documentation is possible if for some reason it was not completed at the time of services. But if done is must be dated on the day it was written not post dated back to the service date. Back- dating is considered fraud or forgery, . Bboth of which are not just a violation of rules, but criminal offenses. There is an example of a facility in Riverside County where nurses asked to falsify records were arrested and taken to jail. The electronic medical record system in use at ARMC should prevent this, but it may be able to be overridden by those with “Administrative” authority.

Healthcare billing and reimbursement is unlike any other profession. There is not a direct correlation between what is billed and what is paid. When an agency or service provider is a Medicare provider they are subject to a concept called “Lesser of cost or charges”. Basically, Medicare sets rates that they will pay. If you participate as a provider of care and bill Medicare you must bill at least the Medicare rate to all others. If you bill less than the Medicare rate to others then Medicare expects that you will bill them at that lower rate. If it is found that others are charged less than Medicare and that is accepted as payment, then the difference that was paid Medicare and what would have been paid at the lower rate is owned to Medicare. Care of County Supervisors and their families is certainly less than the Medicare rate. All similar service delivered at that rate is potentially in jeopardy.

Each facility who bills Medicare or Medicaid must submit an annual “Cost Report”. This is another area that both lack of documentation and failure to bill affects. This annual report is to reflect all appropriate costs and incidents of services delivered. Distilled down to a simplified equation, the total costs divided by the increments of service gives an average cost of service. Where facilities can get into trouble is when they inflate costs by including inappropriate items or report fewer increments of service. In the latter case reducing the denominator inflates the cost per increment. If a facility is found to be providing an inaccurate cost report, Medicare/Medi-Cal can trigger a financial audit that can result in paybacks, withhold of payment and/or fines.

Mark Averbeck, candidate for San Bernardino County/Sheriff Coroner announced today that he has requested the District Attorney’s Office to cause the San Bernardino County Grand Jury to investigate allegations that high ranking members of appointed Sheriff Rod Hoops management team committed fraud and defrauded the tax payers of San Bernardino County by misappropriating over $50,000. For several months now, information has been circulating around the Sheriffs Department and has been reported by one local news organization that as many as fifteen members, both sworn and non sworn personnel, were investigated for falsifying Post Certificate applications. Reportedly, this fraudulent conduct allowed Sheriff Employees, including high ranking administrators, to receive increased pay that was unearned. Appointed Sheriff Rod Hoops Supports Supervisor Paul Biane in this election. Do we need a fresh start?

This is why we need a fresh start in the San Bernardino County Sheriff’s Department.  I have been at meetings where Rod Hoops has said there are big problems on the 5th floor with the Board of Supervisors and he will not go there without a witness with him.  Then he supports one of the problems. I also received the flier with Hoops and Ramos together.  The voters get it.

Why do we need a fresh start? When you have a cloud of corruption over all county government and the board appoints the Sheriff, it is time to vote out all the incumbants.

What do I want to bring into the Department?

Transparency

As part of my fresh start approach to the San Bernardino Sheriff’s Department, it will be my duty to see that the Department is above reproach in order to restore and retain the respect and trust of the public. My first objective is to make all areas of the Department transparent, especially the jails. There will be an open dialogue maintained with the community and community activists who have questions regarding the Department, including the jails.

In order to bring justice to those wronged and closure to those who have done right, I will have all internal investigations expedited. The community will know the truth, and Deputies will be treated fairly and in accordance with “The Peace Officer’s Bill of Rights”.

I attended the San Bernardino County Board of Supervisors meeting Tuesday, May 11. During the comments section two physicians reported concerns they have about the quality of care at Arrowhead Regional Medical Center (ARMC), the political environment surrounding it and the lack of action to correct the problems. iePolitics: And for the Other Mark and Paul

Really, this isn’t for Paul Biane or Mark Kirk because I don’t believe Pinocchio’s, aka Adam Aleman, lies any more today than last week, last month, or last year.  Adam has been telling us forever that the handcuffs are about to be slapped on Biane and Kirk.  Under normal circumstances, for that to happen there has to be a reasonable belief that a crime has been committed.  Jim Erwin and Bill Postmus are the exception but that is a different post.

San Bernardino County District Attorney knows he doesn’t have a case or Biane and Kirk would have been charged.  It’s one thing to charge those like Erwin and Postmus without sufficient evidence.  It’s another altogether to get a judge to sign an arrest warrant or a grand jury to indict a sitting member of the Board of Supervisors or the Chief of Staff to the Chairman of the Board of Supervisors without evidence. After decades of dishonorable San Bernardino County Sheriffs who spend more time cheating on their wives and figuring out ways to cheat the system than doing the honorable thing, either one of you would be a breath of fresh air.  I know both of you are Christians and dedicated family men.

Both of you need to settle down, stop attacking one another, and instead concentrate on attacking the real enemy.  Right now all you are doing is taking votes from one another instead of taking votes from Rod Hoops.  Remember, he only needs 50 percent plus one.

But more importantly, start acting like Christians and stop this!  Seriously.  Debate the real issues.  Bring corruption to the forefront.  Be gentlemen.  Go do the right thing!

iePolitics: POST Scandal

I’ve received two responses so far.  The first is that Stodell is from the Yucaipa area, which fits the situation.  And the second:

The names that I have heard for sure that have been involved in the POST issue are Bill Zehms, Lt. Jerry Davis and Captain Mark Marnati. Sources say that they have confirmed Davis and Marnati but the Department denies this because of their rank and the fact that Marnati had worked in Internal Affairs. If Stodell was involved in this scam then it really dates back a long time as he retired three to four years ago. Now if they have been doing this for that period of time then Captain Gray would owe a lot more money than he paid back that’s for sure.

Please keep the tips coming.  I think we all know there is more to this scandal that what the Sheriff is admitting to publicly.

iePolitics: Don Kurth–Not Impressed

I always have to check out Jessica’s spin as it seems to differ greatly from what others think of the same event.  As I was looking at 63rd Assembly District candidate Don Kurth’s Facebook page, I found this:

Don Kurth did you know I authored and passed a resolution here in the City of Rancho banning medical marijuana dispensaries? We must do the same for the State of California and protect our kids and our communities.

So, he openly admits he thwarts the will of the people.  How many other areas will he put forth his own agenda rather than uphold the will of the people . . . new taxes,  bigger government, amnesty for illegals?  I’d like to know how he picks and chooses which laws to uphold and which ones to disobey.

iePolitics: Mill Creek Meet and Greet

I had a chance to stop by the candidate meet and greet and Mill Creek Cattle Company in Mentone.  It was my first time there although the drive-in in Redlands is my favorite bar-b-que.  I will try to write about this event and Tuesday’s event in more detail tomorrow, but for now I will just say it was nice to see it so well attended by candidates and voters alike.

I finally got to meet both Paul Schrader and Mark Averbeck in person.  It was also nice seeing Mike Morrell and Paul Chabot who are both running for the 63rd.  Don Kurth was also there but well guarded by Jessica Austin and I decided this was probably not the best place for Jessica and I to have any type of discussion.  Acquanetta and Pat both had tables there but were not present themselves.  I didn’t see anything for Henry. iePolitics: Lemkau/Hosking Race

This race seems to be turning into a “lesser of two evils” race.  We all know Judge Lemkau’s claim to fame.   Now we are finding that Hosking is supported by many of the evil doers in this county.  If someone could email copies of both of  their 460s I would greatly appreciate it.  We don’t need to go from bad to worse.

We are going to look much closer to this race in the next week or so.  Feedback on either would be greatly appreciated.
