I’ve already made a California Public Act Request with David Wert to find out if Second District Supervisor Paul Biane has really turned in his Denali or not. iePolitics has been receiving on-going anonymous messages stating that he has not. I haven’t heard back from Wert. Does anyone know for sure?

The general election is only eight days away, and as it approaches, I have been watching with some degree of fascination the implosion of the candidacy of incumbent San Bernardino County Supervisor Paul Biane (pictured). Before shocking revelations that have taken place over the last few days
concerning Biane, the Supervisor was already having a really rough go of it. Last June, well over half of the voters in his district cast their ballot for someone else to replace Biane. His opponent on the ballot, Fontana Councilwoman Janice Rutherford, came in only 3 points behind him. There is a rule in politics that if you are an incumbent and you are held below 50% — you are likely going to lose your re-election. Biane got a pathetic 34% of the vote.

The mailers, sent by Citizens Against Corruption Opposing Rutherford for Supervisor 2010, bring the national debate on independent expenditures home to the Inland Empire.

Diary, where’s my car?
I really love being a county supervisor, but this has been a tough week. Thanks to the pesky media asking questions, I had to surrender my county-issued SUV.
I loved that car. Had everything…A Yukon Denali valued at $50,000 when it was purchased new. Or was it more? Seemed awful nice for only 50 grand. That Denali had leather seats, a rearview camera, and a sunroof. I even charged OnStar Services and XM Satelite Radio to the taxpayers. Who knows what it all cost…but does it really matter? It’s not like I paid for it. But it was MY car, and I loved it.
Diary, I’ll really miss my XM Radio. I got to listen to Notre Dame football games without having to set foot anywhere near Cook County.
The best part was taking my Denali on family vacations to my villa in Mexico. It was great that the County upped the insurance to allow that.
But now I can’t. Thanks a lot, Imran of the Press Enterprise.
Oh well, you know what they say: “TGIF.”
Speaking of TGIF, I’ve spent hundreds of taxpayer dollars at that restaurant, too. It’s always Friday!
I love this job, I really do, but Diary, I really miss my car.

SBSun: Local business owners, builders tied to anti-Rutherford committee
Inland Empire business owners and developers have been linked to three campaign mailers opposing the challenger for the San Bernardino County Board of Supervisor’s 2nd District seat.The committee responsible for the mailers, Citizens Against Corruption Opposing Rutherford for Supervisor 2010, filed its campaign contribution and expenditure forms Friday with the county’s Registrar of Voters Office, naming five donors.
The contributions, totaling $35,000, came from Frank Glankler III, Urban Advisors Inc., Arron Corporation doing business as Alta Loma Limo, Harold Kneller and Gregory Severson.
Total expenditures by the committee equaled $66,840.
SBSun: Officials: Biane’s Mexico trips prompt insurance purchase
San Bernardino County Supervisor Paul Biane’s frequent trips to Mexico in his county-issued vehicle prompted the county to purchase a blanket auto insurance policy covering all county employees who travel south of the border, officials said Friday.Laurie Milhiser, the county’s former director of risk management, said she became aware about two years ago that Biane was driving his county-issued vehicle to Mexico, where his family owns a vacation home about 40 miles south of Ensenada, and was purchasing auto insurance policies at the border.
She said she decided it would be better to find a reputable insurance company and purchase a comprehensive policy that would cover all county employees needing to travel to Mexico.

SAN BERNARDINO (AP) — A San Bernardino County supervisor is turning in his county-provided sport utility vehicle after disclosure of a drunken-driving arrest five years ago in Illinois.
Supervisor Paul Biane released a statement this week calling the 2005 incident a mistake and says he’s turning in the 2007 GNC Yukon Denali assigned to him by the county.

Two years ago county supervisors expressed outrage when then-Assessor Bill Postmus was accused of substance abuse and violation of county policies. We now learn that one of those very same supervisors has his own issues with substance abuse and violation of county policies. Unlike Postmus, Supervisor Biane has already been found guilty of the crime and has offered no proof he has complied with county policy in reporting his arrest and subsequent conviction.

I have heard he had the “Denali” removed from the vehicle so no one would know. Perhaps someone can confirm that.

San Bernardino County Supervisor Paul Biane is returning his county-provided car following a report that he was cited in 2005 for driving under the influence of alcohol.
In a statement this week, Biane called the October 2005 incident a poor decision and said he intended to turn in the 2007 GMC Yukon Denali assigned to him and drive his personal car.
Biane said he received a misdemeanor citation when he stopped to ask a police officer for directions during a trip to Chicago and was driving “slightly over the legal limit.”

Note the arresting officer’s description of Biane’s appearance at the time: mumbled/slurred speech; glassy, bloodshot eyes; swayed while standing; alcohol on breath.
“A couple glasses of wine” would not cause such impairment in someone who is known as a heavy drinker. Biane has had drinking issues for at least a couple of decades. Our own ACU arrested a young Paul Biane for deuce 20 years ago or so. (He also arrested Bob Dutton, which is one of the reasons he got into trouble at the SO.)

Senor Blogger: Meet Chris Mann – Riverside Political Consultant Fronting As A “Taxpayers’ Association Founder”
Do you know Chris Mann? Unless you’re a political insider, you do not. And even if you are and you still don’t, you’re not alone.
Mann is a defeated special district member from Riverside County who is now working as a political consultant, predominantly with clients in Riverside County.
He also heads a sham outfit called the Inland Empire Taxpayers Association. The IETA is basically one of those “on-paper” organizations that offer their endorsement to the highest bidder, or to personal friends, or to friends of friends.

Seriously, the union representing Sheriff’s employees has endorsed Biane, and from what I hear, donated over $200,000 to his re-election campaign, although the donation isn’t yet showing up on the SOS website.

San Bernardino County Second District Supervisor Paul Biane fancies himself to be a crime fighter. Just ask him. Or better yet, check out his campaign mailers where he takes credit for exposing the current corruption scandal. He seems to forget he is named as John Doe No. 5 in the scandal he is claiming responsibility for uncovering. In other words, he exposed his own wrongdoing. And in his mind that means he should be re-elected to office.
Biane’s memory of past events seems to be failing. For example, we find out today he forgot to tell his constituents about his other criminal activity, that is, until he was reminded of it by an article in The Sun. Not telling us until now about his arrest five years ago for driving under the influence while in Illinois could be just an oversight we suppose. But exactly how does one forget for four years that his driver’s license was suspended? It seems he should have been reminded of that each time he turned the key in the ignition of his county-owned vehicle.
Biane’s memory got faulty again when he returned home from Illinois. He forgot to mention his arrest when he returned to his job. Employees who drive county-owned vehicles are required to report any vehicle-related arrests to their supervisor, or in this case, Chairman Bill Postmus, or at very least, then-County Administrative Officer Mark Uffer. Biane forgot . . . again.

Dear Diary,
I bet you thought I was going to write about another pending matter that has arisen, but instead I decided to tell you why I love being a county supervisor.
It’s about helping constituents, serving my neighbors, and implementing positive differences…
Oh who am I kidding? You know me better than that, Diary! It’s the perks. Perks. Perks, as in a government-issued credit card that I can use to buy whatever I want, with the taxpayers picking up the tab.
And when I say whatever I want, I mean whatever I want.
Since I’ve been supervisor, I’ve charged over $27,000 in fine dining to the taxpayers. And when I say “fine dining,” I mean nothing but the best.
Try dinner at Proof Restaurant in Washington, DC, ($127.00). Oh, and then there was the Trattoria in Las Vegas ($315.76). And don’t forget that, when I am not on the road, I always enjoy a dinner at the New York Grill in the Inland Empire ($235.05).
I am especially proud of the $1,252.12 I rang up at the Gaylord OpryLand Hotel in Nashville. And the best part is, I don’t have to pay for any of this!
So, as you can see Diary, I’m living the good life. Just wait ’til you hear about even more of my excursions at taxpayer expense… I got some great new office furniture!

SBSun: Second District Supervisor Paul Biane to turn in county vehicle due to 5-year-old driving charge
Second District Supervisor Paul Biane has decided to turn in his county-issued vehicle due to scrutiny of a misdemeanor he committed five years ago.
Biane was arrested in Cook County, Ill., on suspicion of driving under the influence on Oct. 17, 2005, according to documents from the Clerk of the Circuit Court in Cook County.

Andrew Lamberto is not liking life these days. His shenanigans the other week on the witness stand would have brought about attaboys a few years back. But that was before blogs and before the widespread use of the Internet as a main news source. No longer are readers limited to the one-sided reporting of mainstream media.
Some would say we are one-sided as well and I will admit that sometimes we are. I don’t always see the point in rehashing the other side. We are more about reporting what mainstream media leaves out.

Last night I printed the email I sent to the Board of Supervisors regarding the fact that San Bernardino County Human Resources Director Andrew Lamberto had perjured himself on the witness stand in the Rex Gutierrez preliminary hearing where he insisted that Exempt (Salaried) employees must work 80 hours a pay period. He did so again at the first trial and even more forcefully and blatantly at the current trial. We will be providing those transcripts as soon as they are made available to us.
The Board of Supervisors was made aware of Lamberto’s testimony at the time of the preliminary hearing because it contradicted what he had told them. Because of Rex Gutierrez’ arrest, inquiries had been made regarding Exempt employee work requirements. According to the County of San Bernardino Exempt Compensation Plan, employees classified as “exempt” have to work the number of hours necessary to carry out their duties.
When this language originally came into being, it had to do with the fact that Exempt employees often worked more hours than regular employees, thus the higher compensation package. However, over the years, it has become more common for Exempt employees to work fewer hours, depending on where they work. This language is also meant to take into account the fact that certain positions require a lot of after-hours and weekend meetings and events as well as the ability to work from home.
As we said, Rex’s arrest sent Exempt employees scrambling because, if he could be arrested for time card fraud for not working a traditional 8 a.m. to 5 p.m. schedule or a full 40 hours a week, so could they. An inquiry was made to Lamberto by the Third Supervisorial District. Here is the exchange:
iePolitics: Shame on the BOS but especially Supervisor Derry
This week we expect to see San Bernardino County Human Resources director Andrew Lamberto recalled to the stand in the trial of Rex Gutierrez. After Lamberto’s testimony two weeks ago where he clearly perjured himself on the stand, several of us worked behind the scenes to bring his most recent crime out in the public.
After his perjured testimony at the beginning of this year, I sent the following email to the BOS. It should be noted that email sent to the addresses I used goes directly to their personal Blackberries/iPhones.

Janice Rutherford is the best choice for the 2nd District seat on San Bernardino County’s Board of Supervisors.We endorsed Rutherford in the June primary, when she and four others challenged incumbent Supervisor Paul Biane.
We noted then, and reaffirm now, our confidence in Rutherford, who’s already proven herself an intelligent and dedicated public servant.
Her opponent, Biane, remains entangled in the ongoing investigation into corruption in San Bernardino County and has been identified as an unindicted co-conspirator in what prosecutors contend was a massive conspiracy to steal from taxpayers.

Sources are telling iePolitics that Jim Previti, Sr. is the driving force behind the well-financed campaign to defeat Janice Rutherford in her bid to oust Second District Supervisor, John Doe No. 5, Paul Biane. Chatter is still being heard that some of the Colonies Partners may also be contributing to the effort.
iePolitics: From the rumor mill
iepolitics has been told by a confidential informant relatively close to the source that a Board of Supervisors agenda item is being prepared to move Assistant Recorder Matt Brown into the position formerly held by Betsy Starbuck. Starbuck was Auditor-Controller Larry Walker’s decades-long chief of staff/assistant before he terminated her a couple months ago and hired Matt Brown.
iePolitics: A mystery that needs solving
Well we have a mystery. Hit pieces against Fontana Councilwoman and Second Supervisorial candidate Janice Rutherford started showing up in mailboxes last week. One mail piece asked Rancho Cucamonga residents if they wanted “Fontana’s problems”—a piece clearly meant to spark an elitist attitude by Rancho Cucamonga voters. A second mailer linked Rutherford with Upland Mayor John Pomierski. The mailer pictured above was received today.
The Political Action Committee (PAC) identified on the mailers is ”Citizens Against Corruption Opposing Rutherford for Supervisor 2010.” In their paperwork filed with the Registrar of Voters office all that is listed is an address which belongs to Sutton Law Firm in San Francisco.

This is the first in a five-part series where we examine substance abuse in each of the five Board of Supervisors offices. One district stands head and shoulders above all others for substance abuse so we shall look at that district first.
Supervisor Paul Biane comes from a family of vintners so one would think he would have been raised with restraint around alcohol. But alcohol abuse has played a role in Biane’s life from at least early adulthood when he was arrested for driving under the influence.

Our crisis undermines the feeling of security and well being of law-abiding citizens. It mocks those who gave their blood to protect the Constitution of the United States. It is as evil a crisis as any American community can face.
Our crisis centers around the political aspirations of our district attorney who uses his powers, not just to prosecute criminals, but to persecute political enemies. Justice no longer equates with truth but rather revenge.
California Government Code Section 26500 defines the district attorney as the chief law enforcement officer in the county. It is one of only four positions in any county that is required by the California Constitution to be elected. The others are sheriff, assessor and members of the governing body.
The California District Attorneys Association defines the ethical duties of prosecutors as follows:
SBSun: Rutherford has fundraising edge in campaign’s final weeks

Incumbent County Supervisor Paul Biane has raised and spent much more campaign cash than challenger Janice Rutherford, who is challenging Biane in November’s election, but Rutherford raised more over the past three months and has more cash on hand going into the final weeks of the campaign.Between July 1 and Sept. 30, Biane raised $131,267 in cash and another $30,000 in loans – $10,000 each from Supervisors Brad Mitzelfelt, Josie Gonzales and Gary Ovitt. Rutherford, meanwhile, raised $146,919 in cash and has loaned herself $100,000.
In all, Rutherford reported having $155,188 left to spend as of Sept. 30, while Biane reported having $62,295.
iePolitics: County BOS says “FU” to its female employees
In a move that is not shocking, only disgusting, the San Bernardino County Board of Supervisors gave the finger to all female employees in San Bernardino County. In reality it also gave the finger to all employees who might be the subject of their supervisor’s or manager’s affection. They gave carte blanche to all managers, administrators, and supervisors to sexually harass subordinates as the BOS will pay for their defense if the victim complains. Or should I say, the taxpayers will pay for it.
The Board of Supervisors is very aware of District Attorney Mike Ramos’ sexual exploits with his subordinates and colleagues alike during county time, on county property, and in county vehicles. Most of them personally witnessed him and Doreen Boxer at the City/County Conference in Lake Arrowhead several years ago.
iePolitics: BOS declares war on Second District challenger Rutherford; wants status quo in county government
In a repeat from two years ago, three of four members of the Board of Supervisors are seeking to keep their secrets safe from outsiders. Their worst fears were realized when Supervisor Neil Derry beat out incumbent Dennis Hansberger two years ago despite their support and fund raising on Hansberger’s behalf.
According to a report at www.inlandpolitics.com, three supervisors are again attempting to keep an outsider off of the board. Supervisors Mitzelfelt, Ovitt and Gonzales have all made $10,000 loans from their campaign funds to assist their embattled colleague. Supervisor Derry had sense enough to stay out of it.
Although Biane has the support of three of the county’s four biggest unions, his numbers do not look so good. One month before Election Day he reports less than $63,000 on hand while Rutherford reports over $155,000. And that $63,000 includes $30,000 from his fellow board members, some of whom have a need to keep outsiders off of the board.
Rutherford has run on a ethics reform platform while Biane can only run on a ethics-challenged record, still awaiting determination of a possible criminal indictment. On top of that, the issues at Arrowhead Regional Medical Center where he received free medical care and did not report it have not been resolved as federal investigators are still looking into the matter.
In the June Primary, Biane was rejected by two thirds of the voters. For an incumbent, that does not suggest a good chance at re-election.
As we get closer to Election Day, it shall be interesting to see if Chris Jones can pull off a win with such a funding deficit. Or perhaps some of the Biane’s developer friends will come through for him with the big bucks he badly needs right now.
iePolitics: And in yet another act of trying to keep insiders out of the BOS affairs
Every time we think there may be some hope for transparency and reform with the San Bernardino County Board of Supervisors, we find out they are flat out hopeless. On Tuesday they proved once again they are happy with the status quo and are terrified of real reform.
The Board of Supervisors did two good things on Tuesday, albeit, a year or so after they should have been done. First, they forced Ruth Stringer into retirement. Don’t believe anything else you hear. She was forced!
Second, they reluctantly (except for Derry and Mitzelfelt) approved the Sunshine Ordinance. However, the real proof will be when we ask for public records and they are not denied for bullshit reasons like they are now.

Remember, District Attorney Mike Ramos, during the City-County Conference and in front of dozens of county and city officials, asked if he could “eat Ruth’s pussy.” Well it looks like Ruthie wants to return the favor, figuratively speaking, that is.

There are two perplexing matters before the San Bernardino County Board of Supervisors, the first on Tuesday and the second on Wednesday, that have us wondering if crack(ed) legal Beagle Ruthie Stringer has been given the axe . . . finally. Our very bestest and mostest dependable sources are being quite obstructive and obstinate about giving iePolitics the scoop on this one.
And that’s not fair. This is like being four years old again on Christmas Eve and unable to sleep in anticipation of the big day. Except in this case, we have to wait three and a half days to find out what is going on. Where are our sleeping pills when we need them?

What would you say if you elected someone to office to vote on projects, laws, etc., on your behalf and then after they voted on said items, you found out they had no clue what they voted on? That is exactly what is happening on the Fifth Floor with our Board of Supervisors.
The most recent debacle with Dr. Gnanadev’s conflict of interest statement is only one of many examples where the members of our Board of Supervisors casts votes and have absolutely no clue on what or why they are voting. How would you feel if it was your project, your street, your home, your life they were affecting?

Anyone of these adjectives is an appropriate descriptor of the current five members of the San Bernardino County Board of Supervisors individually and as a not-so-well functioning governing board. Never was it so obvious as it was on Tuesday.
More than a year and a half ago many astute observers began to realize the Board of Supervisors had a problem. Several high-ranking staffers, including County Counsel Ruth Stringer, had become disloyal. In reality, the situation worsened to far beyond disloyal.

San Bernardino County cannot repair its corruption-tainted government by re-electing people linked to scandal. The county government needs a change in political habits and attitudes. And voters can make progress toward that goal by electing Janice Rutherford as 2nd District supervisor on Nov. 2.
Two-term incumbent Paul Biane barely edged out Rutherford in the June primary, winning 34 percent of the vote to Rutherford’s nearly 32 percent. But voters have only two choices in the runoff, instead of the six candidates in the primary. Rutherford offers a clear improvement on the status quo, and that should be the decisive factor for district residents.

Earlier this week, Inland Empire Conservatives released a secret memo from Paul Biane’s campaign. It was both shocking and saddening to see Paul stray so far from the conservative roots he once supposedly believed in.
Today we learned a little more on how far self-described “moderate Republican” Paul Biane has strayed from his relationship with conservatives.

Inland Empire Conservatives has recently received a troubling memo from the Paul Biane for Supervisor Campaign. In it Biane touts his “moderate” views and describes his plans to attack opponent Janice Rutherford for being “strongly conservative.”

At over 17,000 square miles, San Bernardino County First District Supervisor Brad Mitzelfelt holds the distinction of being the local elected official for an area larger than nine states. His First District is the largest county district in the lower 48 states. The fact that that there are only seven incorporated cities with relatively small spheres of influence within that expanse only increases the enormity of the job.
Mitzelfelt began his life in public service by joining the United States Marine Corps in 1986, where he served his country as part of Operations Desert Storm and Desert Shield in Kuwait and Saudi Arabia. He was a public affairs specialist. He reached the rank of Staff Sergeant and served a total of ten years between active duty and reserves.
iePolitics: Did Matt Brown receive a bribe today to keep quiet before the election?
I know that I am not the only one that thinks the county of San Bernardino sunk to a new low today. The decision to pay off former Second District Chief of Staff Matt Brown is a slap in the face to all county employees who must face a real hostile work environment each and every day because they do not have the money for an attorney and the county refuses to conduct a legitimate investigation. County Administrative Officer Greg Devereaux and our Board of Supervisors should be ashamed of themselves.
Of course, this payoff begs the question of Why? Well, the answer is easy. A mistake by the District Attorney’s office has alerted corruption defendants to the fact that Brown was involved in attempting to get his boss, Second District Supervisor Paul Biane, on tape in an undercover operation. It would be highly detrimental to Supervisor Paul Biane’s re-election chances to have his former Chief of Staff tell what he knows before November 2.

It’s finally crunch time in the multi-year corruption probe launched by San Bernardino County District Attorney Mike Ramos.
And one has to wonder what Ramos told Attorney General Jerry Brown in regards to his evidence?
There’s a bigger question starting to be asked by some close to the investigation.
Was Brown lied to?
iePolitics: Another Fifth Floor arrest . . . or two?
That is the rumor. To be more exact, the rumor is that Mark Kirk will be arrested for time card fraud before the Rex Gutierrez case gets underway in a few weeks. We are also hearing Paul Biane’s arrest is imminent.
These rumors can almost always be traced back to our favorite yellow singing Canary, Confidential Informant No. 1, Mr. Max Factor himself, Adam Aleman. It seems that every time Mikey has to face bad news he deflects with disinformation through Adam.
iePolitics: Update on the Guasti Command Post Incident
I have now received multiple confirmations that the incident did in fact take place. I am still trying to verify some of the other participants, but a number of sources have stated that besides for then-Captain Hoops, San Bernardino County Supervisor Paul Biane was also present and among those drinking and having sex with the women. I am still trying to nail down an exact date so we can do a California Public Records Act request on the call logs, etc. I am told that Sheriff’s deputies were complaining about the incident but Hoops silenced them.
iePolitics: Gosh, I Take a Few Days Away from the Blog and . . .
I have to admit I cringed when I saw the story on Joe Tuner. I think very highly of Joe. He’s been accused over the years of some things that haven’t necessarily been accurate, but accurate or not, he has tried very hard to clean up his reputation. And he has done a good job. Mostly, it is gonna just take time.
I think the story tonight illustrates perfectly one of the points in Jason Whited’s piece last week. Because of technology, especially the Internet, past mistakes are not nearly as easily forgotten. Mistakes in the last five years and on into eternity could come back to haunt us for a lifetime.
